Magic World LLC - Terms and Conditions

By accessing or purchasing from Magic World LLC, you agree to the following Terms and Conditions, which govern your use of our website, mobile applications, and services (collectively, the “Service”). If you do not agree, you may not use the Service.

General Terms

  • Age Eligibility: Customers must be 18 years or older to create an account or make purchases. By using our Service, you represent and warrant that you meet these requirements.
  • Account Responsibility: Customers are responsible for safeguarding their account information and ensuring all details provided are accurate and up-to-date. Any fraudulent or inaccurate account information may result in account suspension.
  • Acceptance of Terms: By completing a purchase, whether online, in-store, or via phone, you acknowledge and agree to these Terms and Conditions.

  • Fraud Prevention and Verification Policy: Orders identified as high risk of fraud or containing suspicious details (such as mismatched billing and shipping information or payment discrepancies) are subject to additional verification.

    By placing an order with Magic World Flowers, the customer agrees to cooperate with our verification process when required. In such cases, we will contact the customer via SMS or email to request:

    -A valid photo ID matching the billing name. (Front and back)

    -A photo of the payment card used, showing the name and last 4 digits.

    The customer must provide this verification immediately upon request. If verification is not completed, the order will not be processed.

    Customers who prefer not to share verification details may complete payment instead via Zelle or cash. Once the Zelle or cash payment has been received, verification will no longer be required, and we will issue a refund exception to the original card payment since the payment method has changed.

    Please note that no refunds will be issued for unverified or canceled card transactions. We do not offer refunds unless a cancellation request is made at least 7 days prior to the scheduled delivery date.

    All cancellations are subject to a $25 administrative fee to cover processing and handling costs. Due to the nature of our products (custom and perishable), all sales are final.

Liability and Safety Disclaimers

1.Fragile Items: Magic World LLC is not responsible for damages or injuries caused by the improper handling of fragile items, such as glass or ceramic vases. Handle all fragile items with care to prevent accidents.

2.Helium Balloons: Customers are advised that helium balloons, if mishandled, can pose risks such as choking, fire hazards, or entanglement. Magic World LLC is not liable for any incidents or damages caused by balloons once delivered.

3.Chocolates and Food Products:

    1. Pre-Packaged Chocolates: All pre-packaged chocolates sold by Magic World LLC include ingredient and nutritional labels as provided by the manufacturer. Customers are responsible for reviewing these labels for potential allergens or dietary restrictions.
    2. Unlabeled Chocolates in Arrangements: Some arrangements include Ferrero Rocher chocolates that are removed from their original packaging as part of the design. By purchasing an arrangement with chocolates presented out of the box and without manufacturer labeling, customers accept full liability for any risks, including but not limited to food allergies or dietary sensitivities. These chocolates contain the following:
      • Ingredients: Milk chocolate, hazelnuts, sugar, palm oil, wheat flour, whey, low-fat cocoa powder, lecithin, sodium bicarbonate, and salt.
      • Allergens: Contains milk, hazelnuts, wheat, and soy.
      • Nutrition Facts (Per 100 g):
        • Total Sugars: 40 g
        • Added Sugars: 36 g
        • Protein: 8 g
        • Calcium: 100 mg
        • Iron: 2 mg
        • Potassium: 370 mg
    3. Magic World LLC is not liable for any health issues or allergic reactions resulting from the consumption of these chocolates. Customers are advised to take these details into consideration before purchasing.

 

4.Arrangement Mechanics: Structural materials in arrangements (e.g., wood sticks, staples, crystal pins) are not toys. Customers must ensure these materials are handled safely and kept away from children.

5.Use of Arrangements: Flowers, plants, and accessories are for decorative purposes only and should be handled responsibly to avoid harm.

Delivery and Pickup Policies

1.Delivery Standards:

    • Magic World LLC guarantees delivery to the specified address in good condition. Once delivered, all responsibility passes to the recipient or customer.
    • If the recipient is unavailable at the time of delivery, we will attempt to contact the customer and recipient for further instructions. If no response is received, the arrangement will be left at the provided address.

2.Customer Responsibility:

  • Customers must provide the correct delivery address and ensure the recipient is available to receive the delivery.
  • Magic World LLC is not responsible for missed deliveries due to incorrect addresses or recipient unavailability.

3.Weather Conditions and Force Majeure:

  • In extreme weather or unforeseen circumstances, delivery times may be delayed. Magic World LLC is not liable for delays caused by natural disasters, strikes, or other events beyond our control.

4.Pickup Policy:

  • Arrangements are available for pickup during regular store hours (Monday-Friday, 9 AM-6 PM; Saturday, 10 AM-6 PM and Sunday, 11 AM-2 PM).
  • Orders are ready 4 business hours after placement (e.g., an order placed at 6 AM will be ready at 1 PM).
  • If arrangements are not picked up within 24 hours, the order will be marked as complete.

Refund and Return Policy

  1. Final Sale: Due to the perishable nature of our products, all sales are final. No refunds or exchanges are permitted.
  2. Delivery Failures: If an arrangement is returned to our store because the recipient was unavailable and the customer explicitly requested not to leave it unattended, the order will be held for 24 hours. If it is not picked up or re-scheduled within this timeframe, the order will be considered completed and fulfilled. Customers may arrange for re-delivery for an additional fee within 24 hours from attempted delivery.

  3. Fraud Prevention and Verification Policy

    Orders identified as high risk of fraud or containing suspicious details (such as mismatched billing and shipping information or payment discrepancies) are subject to additional verification.

Submissions and Marketing

  1. By purchasing from Magic World LLC, customers consent to the use of photographs of their purchased arrangements for marketing purposes unless explicitly stated otherwise at the time of purchase.
  2. Customers may not upload images or content to the Service without proper permissions. Magic World LLC reserves the right to remove any inappropriate content.

Mandatory Arbitration and Class Action Waiver

  1. Arbitration Agreement: Any disputes arising from these Terms or our Service will be resolved through binding arbitration. By agreeing to these Terms, you waive your right to bring disputes to court, including the right to a jury trial or to participate in class actions.
  2. Notice of Dispute: Customers must first attempt to resolve disputes informally by submitting a Notice of Dispute to hello@magicworldflowers.com.
  3. Class Action Waiver: All disputes must be resolved individually. Class actions and other representative proceedings are not permitted.

Limitation of Liability

Magic World LLC and its affiliates are not liable for indirect, incidental, or consequential damages arising from the use of our Service, including but not limited to injuries caused by fragile items, helium balloons, or allergies from food products.

Product Disclaimer

By purchasing from Magic World LLC, customers agree to all Terms and Conditions, including:

  • Responsibility for fragile and decorative items after delivery.
  • Acceptance of substitutions for arrangements when necessary.
  • Awareness of potential risks from structural materials in arrangements.

This disclaimer is included on all product pages and applies to all purchases.
